Release of Liability and Assumption of Risk

 The individual named below (referred to as “I” or “me”) desires to participate in the Saranta Detox Cleanse, a six-session online program enhanced by the use of nutritional supplements (the “Activity”) provided by Starkel Nutrition, PLLC (the “Company”). In consideration of being permitted by the Company to participate in the Activity and the intangible value that I will gain by participating in the Activity and in recognition of the Company’s reliance hereon, I agree to all the terms and conditions set forth in this agreement (this “Release”). 

I agree to participate in the 6-week Saranta Detox Cleanse ("Program") which includes 6 sessions, a community chat forum with live chat sessions, a manual, a recipe booklet and dietary supplements.  An optional add-on Saranta Data Geek special ("Add-on") includes 2 urine toxin tests and 2 thirty-minute sessions with an expert.

The term of this agreement is for the entirety of the Program, which is available to me for three months.  The Program and Add-on are available through StarkelSaranta.com.

Starkel Nutrition, creator of the Saranta Detox Cleanse and the Data Geek Add-on, retains all rights, title and intellectual property that is used in connection with the Program. 

The cost of the Program is US$499 and the cost of the Add-on is US$449 payable in advance of the Program and Add-on. 

Assumption of Risks regarding Nutritional Supplements

I understand and acknowledge that I will be offered to consume nutritional supplements as part of my participation in the Activity and that nutritional supplements are not approved by the Food and Drug Administration (“FDA”). I am aware and understand the potential risks of participating in this Activity, which may include, but are not limited to, medication interactions and allergic reactions. I understand and acknowledge that it is impossible to consider and list all possible risks here and that I have been advised to review the drug nutrition interactions provided on Company’s website located at StarkelSaranta.com under the frequently asked questions section. 

I further understand that I have been advised that the use of nutritional supplements is not meant to diagnose, treat, cure, or prevent any disease or medical condition, and that I should consult with my physician prior to starting any nutritional supplement program. I additionally understand that I should also consult with my physician regarding any potential adverse interactions between medications I am currently taking and nutritional supplements I will be offered to take in participation of this Activity before taking any such supplements. If I have, or suspect that I have, a medical problem, I will consult with my physician for diagnosis or treatment prior to participating in the Activity. 

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, I KNOWINGLY, VOLUNTARILY AND FREELY ASSUME ALL RISKS, BOTH KNOWN AND UNKNOWN, OF PARTICIPATING IN THE ACTIVITY, AND I ASSUME FULL RESPONSIBILITY FOR PARTICIPATION IN THE ACTIVITY. 

Release and Waiver

I acknowledge and agree that:

• I, the undersigned, am at least 18 years of age. 
• I have reasonably assessed the risks involved in the Activity and have made an informed and voluntary choice to participate.
• I alone, and not the Company, am responsible for determining my health and overall fitness for participating in the Activity and my ability to fully understand any directions or warnings presented.
• I will not participate in the Activity if I have or suspect I have a medical problem or condition without first consulting my physician for diagnosis and treatment, or if I am aware or should reasonably be aware of any other factors that may prevent me from safely participating in the Activity.
• I will carefully read all product packaging and labels, and I understand that if I notice any adverse reaction during the Activity, I will immediately stop participating in the Activity and immediately seek consultation from my physician.
• I will act reasonably and responsibly and will comply with any provided and customary conditions, directions, and/or precautions for participation in the Activity. 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, I RELEASE AND PROMISE NOT TO SUE COMPANY FOR ANY CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES (WHETHER ECONOMIC OR NON-ECONOMIC), DAMAGES, EXPENSES, COSTS OR LIABILITY OF ANY NATURE WHATSOEVER ARISING FROM OR IN CONNECTION WITH THE ACTIVITY, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY.

I intend this Release to be a complete and unconditional release of all liability to the greatest extent allowed by law. I agree that if any portion of this Release is held to be invalid, the balance notwithstanding shall continue in full force and effect.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY PROVIDES THE ACTIVITY “AS IS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMPANY EXPRESSLY DISCLAIMS ANY WARRANTIES OF SAFETY, FITNESS FOR A PARTICULAR PURPOSE, AND AS TO THE ADEQUACY OF THE DIRECTIONS AND WARNINGS PROVIDED TO YOU.

Indemnification

I agree that if, despite this Release, anyone on my behalf makes a claim against Company relating to the Activity, I will indemnify and hold Company harmless from any liability, demand, loss, damage, or costs which Company may incur as the result of such claim.
